ARTICLE 1. PARTIES

These general terms and conditions apply between Mes Culottes LLC, a Limited Liability Company, VAT number (EIN): 38-4375090, ACN 2025-001814591, Registered office: 30 N Gould St Ste N Sheridan, WY 82801 - United States, email: contact@mes-culottes.com, Tel: +1 (307) 310–4644 (hereinafter referred to as "the Publisher"), and any individual or legal entity, whether private or public law, registered on the Site to purchase a Product (hereinafter referred to as "the Customer").


ARTICLE 2. DEFINITIONS

  • "Customer": Any individual or legal entity, whether private or public law, registered on the Site.

  • "Site Content": Any elements published on the Site, whether protected by intellectual property rights or not, including texts, images, designs, presentations, videos, diagrams, structures, databases, or software.

  • "Publisher": Mes Culottes LLC, in its capacity as the Site's publisher.

  • "Internet User": Any individual or legal entity, whether private or public law, connecting to the Site.

  • "Product": Any goods sold on the Site by the Publisher to Customers.

  • "Site": The website accessible at the URL mes-culottes.com, as well as its subsites, mirror sites, portals, and related URL variations.


ARTICLE 3. SCOPE OF APPLICATION

The Site is freely accessible to all Internet Users. Browsing the Site implies acceptance by any Internet User of these general terms and conditions. Simply connecting to the Site, by any means, including via a robot or browser, will imply full acceptance of these terms and conditions. When registering on the Site, this acceptance will be confirmed by ticking the corresponding box.

The Internet User acknowledges that they have fully understood and accepted these terms without restriction.

Ticking the box mentioned above is considered equivalent to a handwritten signature by the Internet User. The Internet User acknowledges the evidentiary value of the Publisher's automatic recording systems and, unless proven otherwise, waives any contestation of them in case of dispute.

These general terms and conditions apply to the relationship between the parties, excluding any other terms, including those of the Internet User.

Acceptance of these general terms and conditions assumes that the Internet User has the legal capacity necessary to do so, or in the absence thereof, has authorization from a tutor or curator if they are unable to do so, from their legal representative if they are a minor, or is authorized by a mandate if acting on behalf of a legal entity.


ARTICLE 4. OBJECT OF THE SITE

The Site's purpose is the sale of Products to Customers.


ARTICLE 5. ORDERING PROCESS

5.1. Order
To place an order, Internet Users can select one or more Products and add them to their cart. The availability of Products is indicated on the Site, in the description of each item. Once their order is complete, they can access their cart by clicking on the corresponding button.

5.2. Validation of the order by the Internet User
When reviewing their cart, the Internet Users can check the number and nature of the Products they have selected and verify their unit price, as well as the total price. They will have the option to remove one or more Products from their cart.
If they are satisfied with their order, Internet Users can validate it. They will then be directed to a form where they can either log in if they already have an account, or register on the Site by completing the registration form with their personal information.

5.3. Payment by the Customer
Once logged in or after completing the registration form, Customers will be asked to verify or modify their delivery and billing details, and then proceed to payment via a secure payment interface displaying the phrase "order with payment obligation" or a similar phrase.

5.4. Order Confirmation by the Publisher
Once the payment is effectively received by the Publisher, the Publisher agrees to acknowledge receipt to the Customer electronically within 24 hours. Within the same timeframe, the Publisher agrees to send the Customer a confirmation email summarizing the order and confirming its processing, including all related details.


ARTICLE 6. PRICE - PAYMENT

6.1. Price
The applicable prices are those displayed on the Site at the time of the order. These prices may be modified at any time by the Publisher. The prices displayed are only valid on the day of the order and do not apply to future purchases.
Prices are shown in euros, all taxes included, excluding shipping fees.

6.2. Payment Methods
The Customer can pay via Visa (Credit/Debit card), MasterCard (Credit/Debit card), American Express, Maestro, Bancontact, Apple/Google Pay, and Paypal.
Payments are secured by PCI-DSS certified partners. The order is shipped only after payment validation.

6.3. Invoicing
The Publisher will send or make available to the Customer an electronic invoice after each payment. The Customer expressly agrees to receive invoices electronically.


ARTICLE 7. RESPONSIBILITIES OF THE PUBLISHER

7.1. Nature of the Publisher’s Obligations
The Publisher commits to providing the necessary care and diligence in delivering Products that meet the specifications of these General Terms and Conditions. The Publisher is only responsible for an obligation of means concerning the services described herein.

7.2. Force Majeure - Fault of the Customer

  • 7.2.1. Force Majeure
    In the context of these general terms and conditions, a force majeure event, such as a fire, epidemic, explosion, earthquake, fluctuations in bandwidth, provider failures, network issues, hacking, security breaches, flooding, power outage, war, embargo, legal requirement, government order, or strike, will release the Publisher from its obligations to the extent of the disruption caused.

  • 7.2.2. Fault of the Customer
    The Customer is responsible for any misuse of the Service, negligence, or failure on their part or their agents, as well as the provision of incorrect or outdated personal information.

7.3. Technical Issues - Hyperlinks
If access to the Site is not possible due to technical problems, the Customer will not be entitled to claim damages or compensation. The Publisher is not liable for the unavailability of services or the consequences of accessing third-party websites via links.

7.4. Damages
The Publisher’s liability is limited to direct, personal, and certain damages suffered by the Customer due to the failure in question. The Publisher will not be liable for indirect damages such as data loss, commercial harm, or loss of profits.

7.5. Hyperlinks and Site Content
The Site's content is published for informational purposes and is not guaranteed to be accurate. The Publisher is not responsible for any omissions, inaccuracies, or errors in these materials.


ARTICLE 8. DELIVERY

Delivery is available primarily in France and most international countries.

ARTICLE 9. RETURN AND REFUND POLICY

In accordance with international e-commerce policies:

Right of Withdrawal (for customers in France/EU)
The customer has a 14-day period after receiving the product to exercise their right of withdrawal, without justification.

ARTICLE 10. WARRANTIES

The products sold benefit from the legal guarantee of conformity and the warranty against hidden defects for consumers located in France or the EU, in accordance with Articles L217-4 and following of the French Consumer Code.

ARTICLE 12. LIABILITY

Mes Culottes LLC cannot be held responsible for damages resulting from:

  • Misuse of the product,

  • Poor maintenance,

  • Delays or losses caused by the carrier,

  • Any case of force majeure.


ARTICLE 13. PERSONAL DATA

The personal data collected is used exclusively for order processing and in accordance with GDPR for customers residing in France or the EU.

ARTICLE 14. INTELLECTUAL PROPERTY

All elements on the Site (photos, texts, logos, designs) are the exclusive property of Mes Culottes LLC and are protected by US and international copyright laws.
Any reproduction without authorization is strictly prohibited.


ARTICLE 15. APPLICABLE LAW AND DISPUTES

These General Terms and Conditions are governed by US law.
For customers residing in France, mandatory provisions of French consumer law also apply.
In case of dispute, an amicable solution will be sought before any judicial recourse.
